  • Capture every communication about the investigation (emails, Teams/Slack messages, voicemails). Download or screenshot anything hosted on employer systems.
  • Ask for the written policy or contract clause being used. Colorado FAMLI requires notice and an explanation of alleged misconduct unrelated to protected leave.
  • Do not give medical details to non-HR investigators. Refer them to the FAMLI or ADA/FMLA contact and provide only the claim confirmation number when required.
  • Preserve pay stubs, trip pairings, crew schedules, attendance points, doctor certifications, and FAMLI benefit statements in a secure personal folder.
  • Log any retaliation (schedule changes, discipline, threats) with dates, witnesses, and what FAMLI activity you engaged in.

FAMLI investigation kit

  • Copy of your FAMLI application, medical certification, and benefit notices
  • Employer leave request, response, and any denial/approval emails
  • Attendance/PERF logs at least 6 months before the leave

If you’re pulled from the line

  • Request the reason and whether it is paid or unpaid status in writing
  • Ask whether scheduling holds (RST, POI, LOA) can be coded as protected leave
  • Clarify representation rights (union, peer rep, counsel) before interviews
  • Note any deadlines to respond and ask for extensions in writing if you need counsel
